What Is a “No-Fault” State?

The phrase “no-fault” refers to a law stating that both parties involved in a motor vehicle accident must file claims with their auto insurance companies, regardless of fault. Because of this, all Florida drivers are required to carry at least $10,000 of Personal Injury Protection (PIP) insurance per accident.

But PIP insurance only covers a certain amount of medical bills and lost wages. If your injuries are serious enough to meet the law’s injury threshold or your expenses exceed your PIP coverage, you may choose to file a claim against the other driver in a no-fault state.

How Long Do I Have to File A Claim?

The period during which you may file a claim for injuries sustained in an accident is known as the statute of limitations. Florida’s personal injury statute of limitations is four years. Some exceptions, such as medical malpractice claims, have a statute of limitations of two years.

After a car accident, you have four years from the date of the crash to file a claim against the other party and recover damages not covered by your insurance.
